    Lintel missing 1970 building

    Should our service charges pay for a lintel above my replacement windows of my owned flat in 1970 block I am replacing old pvc windows at my cost and there is no lintel which i believe is now necessary for building regs Is this not part of structure of building ?

    Repairs to structure will normally come from service charge, who else would pay for your flat ?
    Are you sure there's no lintel - even stone age man put lintels in.

      They didn't in my brother's house in Cheshire for a couple of windows, Edwardian I'd say.
      I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          You should put one in just to make it safe for persons inside the flat. Some times the builders employ contract brick layers who "make do" without and don't bother to follow the regulations. A few years ago, the neighboring block of flats were found without wire ties between outer and inner brick walls.

            Wonder if you can help... This week I have received a Court Claim form pack with what seems to include a ‘particulars of claim’ and ‘lease’ for ‘outstanding arrears of Ground rent and insurance’.

            Now this is a huge shock as I’ve not received any letters at all, no emails or phone...

            FYI - I pressed and stated facts and quoted the law etc and they eventually backed down... Mega Chuffed. Didn’t even have to pay any of the legal fees or additional costs. It helps that in the lease as mentioned they had to email or send mail via recorded delivery... Their legal team agreed and dropped...

            Many flats with ground rent increasing every 10 years are not able to get a mortgage loan . Taylor Wimpey have set a side £130 Mil for correcting the ground rent demands in their leases . If your flat was built by this company, you should contact the company for correction of the lease.
