    Shareholders' Agreement: Tenants in Common

    Hi

    Firstly happy New Year.

    I wonder if anyone can provide information, advice or signposting to a template for a Shareholders' Agreement. I am transferring a percentage of my property and will need an agreement to clarify the percentage that will be owned by each party.

    Tenants in common are not shareholders. I think you are thinking of a trust deed.

      The registration of property title in the names of 2 to 4 persons under "Tenants in Common" can be used to declare the % share owned by each person. If more than 4 persons, then registration under a company name may be necessary. You need to consult a solicitor about this and what rules apply when one party wants to exit.

        Thank you both for responses.

        I am transferring or selling (whichever I am advised to do) a small percentage of my leasehold to a company owned by me. So from your comments Gordon999 the percentage will be recorded on Land Registry forms. However, I know the Land Registry do not record these details so anyone checking the record would need to apply for a copy of the TR1 to see the shareholding. This is the reason I wondered if I should also draw up a separate shareholders' agreement. Any thoughts appreciated.
