    Do landlord's get referenced by estate agents?

    I'm just curious as tenants have to go through a referencing process. For instance if a potential tenant had a criminal conviction or a CCJ obviously estate agents will not recommend these people to the landlord but do landlords get referenced? After all tenants are PAYING to rent a landlord's property- they are not running a free rental service.

    Let me give an example.

    A landlord has been convicted for assault ,They have been left an inheritance by a relative in the form of a house. They now want to rent this house out. There is a dispute between landlord and tenant, this particular landlord in this case is a violent, law breaking individual who will think nothing of entering this own property to assault the tenants.

    What is set in place for the tenants to stop this kind of case occurring?

    The agent works for the landlord. The agent is paid by the landlord.

    There is nothing to stop a tenant paying their own independent agent to vet landlords. Or to insist on getting a credit/criminality check on the landlord before considering a property.

    The real problem is that laws and rules lock parties into contracts and dictate the terms of those contracts. Under normal conditions otherwise, if a landlord or tenant was abusive the tenant would just leave (or visa versa) within reason.

    There are already perfectly good laws to deal with assault.

    When folk have tried to set up rules that attempt to protect people they tend to achieve the opposite and attention is diverted from the real problems. The various rules making anyone working with children have entirely spurious waste-of-time police checks is a good example of this (the various paedophile gangs didn't need such checks).

      Anyone who thinks that the new Scottish system of landlord registration will protect anyone at all (it will cost tenants however)
      or who thinks that burdens placed on Doctors to prevent another murderous Harold Shipman
      actually work
      simply doesn't understand the way the world works

      and who profits from these schemes.

      The NHS and doctors are more dangerous than ever (in part thanks to these schemes). Doctors spend hundreds of hours filling in ludicrous pointless forms every day and playing games -- instead of keeping their medical skills upgraded. And when the NHS wants to abuse staff who ask too many questions -- they use these very schemes to achieve that.

        Sadly, no: I've often wondered why tenants don't ask for references - for the landlord - from previous tenants.... Tenants are as entitled to ask for such references as landlords are entitled to ask of tenants...

        Andrew: Do you have personal experience of Scottish Landlord registration??
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...
