    legality of infinity charges by letting agent?

    My letting agent agrees that I can terminate their services, but claims I have to continue to pay them commission as long as the tenant remains in my house. Is this true?(The tenant has been in the property for 2 years).

    Welcome Diane: I can't read from here the original terms you agreed between yourself & your agent when you started - not the tenancy, but agents terms & conditions. Could you check??

    Such a term is very common - suggest you ask your esteemed agent to point out how & when & in what form (email, signature, piece of paper waved at you from 10 feet away..) your agreement was gained...

    If the agent has been seriously negligent you may probably fire them & claim you are no longer bound by such a clause anyway...

    Someone better informed will be along soon hopefully...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      If you read the OFT v Foxtons case, I believe the judge makes a passing remark about this sort of clause being justifiable (assuming you as LL are a consumer) for about 4-5 years. I don't have that case to hand, but it may be worth you looking at it.

        I'm not sure I understand. Why would the letting agency want 4 months rent free? Is this one of these arrangements where you let the properties to the letting agency and the letting agency then sub-lets the properties to other people?

        Hi,

        another topic on this but apologies as i cant find my answer on the other ones.
        My letting agent messed up the check in and check out report. Basically they keep telling me to pay the deposit back without really checking the reports.

        Wanted to post a quick update in case this is useful for anybody else.

        There is no fee for the letting agent to register with HMRC to handle NRLs, all they need to complete the inline form.
        As soon as a letting has registered they need to start collecting tax on behalf of the HMRC....
