    12 months rent in advance

    The letting agent that manages my property on my behalf has received 12 months rent in advance from new tenants. Is it the case that I can request the agent transfers the full amount to me, minus their fee for setting up the tenancy + their first month's management fee, on the understanding I would then need to transfer money to the agent each month to manage the property?

    What does your agreement with the agency state on this question, please?
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      The only reference is as follows: "collecting the rent and paying over to the landlord less any fees or expenses due or incurred for the period". The period of the tenancy is 12 months but my contract with the agent requires only 2 months notice - would I nevertheless be expected to pay the agent their management fee for the 12 month period, on the understanding that I would need to request any outstanding amount be returned to me if I gave them notice within the next 12 months?

        Complain via their complaints process. If that fails use letting agent redress scheme - see Shelter website for details

            They should pass on the rent less their initial fee plus 12 monthly fees.

            if your agreement with the agent allows you to end the agreement with 2 month's notice and without other conditions, you may have found the nicest agent in the country.
            When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
