    Estate Agent email

    I have a court possession order for tenant to vacate early next month but my estate agent has just sent an email saying they have renewed my contract for 3 months. It does not say it has gone into periodic just renewal. The court order was issued before the tenancy renewal email. The renewal date starts before the tenant has to vacate.

    AST has ended in June and there were no renewals or any emails from them until today. Does it affect my possession court order ?

        I think, at the very least, the agent has potentially made things complicated for you.
        Worst case, they've completely screwed you.

        What on earth did they think they were doing?

            When you became their client you almost certainly agreed to terms (eg in an email) granting them the right to do such things on your behalf. Had you informed agent of the court action & progress through each stage??

            How much did they charge you for this kind act of theirs?? Ask them in writing/email why 3 months (rather then say 6 or 12).

              I have sent an email asking to cancel the renewal. It looks like an error. I was on periodic rolling contract. I don't know where they got 3 months from. Nobody called me to discuss the 3 months renewal. They knew that I issued a possession order.

              Totally ruined holiday for me. I have to wait now when their offices will open.

                If renewal has happened it can't be cancelled unless tenant agrees to an early surrender. (IMHO)

                Think you've got to start again . Was it s21 or s8?

                Any other views stating PO still valid? I'm assuming renewal was dated after PO .

                  I did not agree to this extension. Never asked for it. The agency never asked me. I sent an email to cancel it before the start date which is in a few days time.

                  The agency has not right to produce renewals without consultation with a landlord ?

                  I will never be able to get a possession of the property if the agency will be creating renewals without consultation with me. If they produce renewals every 3 months how do you get possession ?

                    It may not be terminal.
                    The possession order is arguably still valid.

                    But the agent's actions are going to take some explaining.

                      Thank you all for your support. I hope I will be able to sort this out with the agency. I spoke to a few tenants in my building they all say they had to sign the renewal agreement. So maybe it is for another property but admin messed it all up ?

                            It was just an extension of periodic tenancy.

                              A periodic tenancy renews automatically each period until its brought to an end in the usual way, so its not within their gift to extend it. I'm not sure what they have promised the tenants, but I hope it doesn't scr*w things up for you.
