    Out of Hours / Christmas Emergency Call Outs

    My letting agent has just sent me an email (I am a landlord for a flat in Bedford UK), advising that they have signed up with a specific company to provide an out of hours / Christmas period maintenance service, such that if there is a problem out of hours or over the Christmas period it will be dealt with promptly. This is not an issue. The issue that I have is that the email states that unless I specifically respond rejecting the service, I in effect sign up to it and agree to pay the fees stated, is this an enforceable arrangement? The email is of a generic nature not personally addressed to me. There is no date upon which the service becomes effective, nor when my opt out needs to be provided by. Does anyone have any experience of this type of thing?

        Unless your agreement (existing agreement) permits such a specific change they cannot impose such a change.

        I'd fire the agent
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          Any offer that you accept by inaction isn't a valid contract.

          That said, I'd check if your agreement with the agent requires them to offer this service (my agent doesn't for example) and write and decline, just to avoid any hassle (and point out that their "offer" isn't legal while you're at it, or don't bother).
          When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
          Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

            I'm not sure I understand. Why would the letting agency want 4 months rent free? Is this one of these arrangements where you let the properties to the letting agency and the letting agency then sub-lets the properties to other people?

            another topic on this but apologies as i cant find my answer on the other ones.
            My letting agent messed up the check in and check out report. Basically they keep telling me to pay the deposit back without really checking the reports.

            Wanted to post a quick update in case this is useful for anybody else.

            There is no fee for the letting agent to register with HMRC to handle NRLs, all they need to complete the inline form.
            As soon as a letting has registered they need to start collecting tax on behalf of the HMRC....

            I am a non resident landlord. My letting agent has stated they are required to have 5 or more NRLs to register with the HMRC. Is this correct? Is there a fee to the letting agent?
