  • I have been turned down on my buildings insurance claim

    help

i have been paying my premiums for over 3 years now to let protector.com and no claims until storm a few weeks ago
put in a storm damage claim for damage to my flat roof, had the usual visit from loss adjuster from Davies adjusters, chadwell heath and SIX weeks later i was told that my insurance was void as i hadnt told the insurance company that my GARAGE had a flat roof!
So Markel International , the underwriters told me now that i have NO insurance and have returned my premium paid
    Wot a stich up

here is a copy of the SMALL print: notice paragraph (i)

"was built in or after the year 1800

    (b) is in a good state of repair

    (c) is built of brick, stone or concrete and roof made with slate, tiles, metal, concrete, or flat roofed with asphalt, bitumen, concrete or felt on timber

    (d) is not a grade I listed building

    (e) is not troubled by flooding or in an area troubled by flooding

    (f) is not troubled by subsidence, landslip or heave and not in an area troubled by subsidence, landslip or heave

    (i) if flat roofed, complies with the following warranty: It is warranted that all flat roof sections be inspected and tested at least once every two year period by a qualified independent building/roofing contractor and a certificate issued confirming the roof section is in a sound weather proof condition

    (j) does not house any asylum seekers/refugees/holiday homes

    (k) is not and will not be having any structural work carried out other than standard renovation
(internal painting and decorating, tiling, replacement of bathroom and/or kitchen fixtures and fittings including sinks, wash basin, W.C.,bathroom and shower, carpeting, internal joinery, plastering, central heating installation and external window replacement) "

I have come across Let Protector. They are run by Commercial Express and now use Navigators Insurance. Markel and Navigators are both American companies and when I last checked, Navigators were not part of the Association of British Insurers. This does not affect their creditworthiness but they will not have the back up of this association.

The wording needs to be read carefully. They only give Liability of £1,000,000 unles you pay extra premium.

If your property becomes vacant and you do not tell them, cover is excluded. You must also have a Corgi certificate and inspection of the electrics by a qualified electrician otherwise cover does not apply.

Some Underwriters have this clause in the Policy Wording:

"We may enter any building where loss or damage has happened, take possession of the insured damaged property and deal with any salvage in a reasonable way"

Should any clause like this be legally based or...

That looks like a very standards clause. For portable property, it stops you gaining extra money by selling it on Ebay. I think it is mainly for things that can or will be removed, but they would also want complete control of the site during any major rebuilding work.

I can't answer specifically but it seems to me that any clause in an underwriter's policy which you sign up to when you take out insurance would be "legally based" under contract law.

What kind of risks are you envisaging?

        Hi All

I have had a buy to let for 11 years and recently while my wife and I were clearing the front guttering, she accidentally fell off a ladder into the front wall and caused it to collapse (she was not hurt, just bruised). I made a claim to my insurance company.

        I hold...

I agree with the others that for a wall in general, and a 'thick' wall like yours in particular to move that way just because someone essentially pushed on one side it must be inadequately designed and built.

At least your wife is lucky because if the wall had not moved she would have hurt...

I'd have thought that if the wall hadn't fallen over, the wife could have been badly hurt.
