    Joint tenancy change

    Hi . My first post. Hope someone can help.
    my tenants are splitting up but one wants to stay with the kids. I'm currently paid direct by the tenant who wants to leave via direct payments from their universal credit claim.

    Their short term agreement period has expired. She now wants a new tenancy agreement in her name only. Can I simply give her a letter saying she can continue on the periodic agreement as before (she is named in the existing agreeement) I don't want to give her a guarantee of a full 6 months until I've seen how she pays alone? Or does it have to be a full new tenancy agreement?

    Best option is do nothing:

    That one leaves does not end their obligation to pay.

    You are always better off to have two people to sue for rent
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      I agree. Thanks for fast response. I Always stay with the periodic .. quicker to get them out!!! She is asking for a new agreement for the payment of rent to come direct from the 'staying' tenants universal credit. They have been in for about 3 years with minimal issues and have always paid their rent.. so I don't want them to go!! But I've always dealt with the one who is leaving, so am a bit appehensive! Not sure how she will be at paying!.. hence i don't want to give a new agreement... just an amendment, but not sure if this would stand up in court if I need to get her out!

        Do nothing at this stage and see if she pays the rent.
