Eviction of company let

Hi

I currently let a property to a company who then sublet each individual room as HMO. The company have fallen behind with paying rent to me (although I know the rooms are all occupied) and I have had enough of their false promises. I just want to get them out of the picture, happy for the tenants themselves to stay.

I have looked online for how to evict the company as I know it isn’t a normal tenancy set up so cannot use normal section 8/21 notices - looks like a notice to quit is needed instead.

Has anyone had a similar experience? Any advice gratefully received!

Suggest You use NTQ with details derived from the tenancy agreement between you and the company. There should be clauses about how that tenancy may be ended by either party. Please don't tell us company supplied agreement.

The occupants, if on ASTs stay on those with you as new landlord, under s18 of 1988 housing act.

Professional advice from a company specialising in this sort of rent-2-rent scheme/scam is probably advisable.

Do you have any personal guarantees from any directors.

Expect a series of disappointments trying relevant paperwork regarding occupants (gsc, EPC, deposit, how2rent etc).

You have made a big mistake with this let in my opinion. Google rent to rent scam to understand some of the problems with this type of letting.

As above, you will likely inherit the occupants as your direct tenants if you manage to successfully evict the company, (and that's a big if as in many cases they will have altered or deleted the forfeiture clause in the agreement). You need legal help from a specialist housing solicitor to get yourself out of this one.
