    What fines or consequences are there for a small HMO that breaks the rules?

    What fines or consequences are there for a small HMO that breaks the rules? (3-4 people).

    There's a lot of info about licensable HMOs (5+people) but nothing out there for non licensable HMOs (3-4 people). The rules for small HMOs are written in fairly ambiguous language so depending on interpretations some people may end up unintentionally vulnerable to breaking the rules.

    The reason you've not received answers is because no one here knows.

    I believe only licensable HMOs tend to receive fines, but don't quote me on it.

        Possibly have to refund all rent (yes, really), any s21 invalid, being put on rogue Landlord database, and I suspect possible criminal record.

        Each unlikely but why risk any of them

        ​​​​​​Logically / ethically the same as asking why not steal from local sweet shop. You might get away with it, but.....

        What training in Landlord/tenant law?
        I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

          The regulations relating to HMOs are enforced by local authorities and are implemented by either improvement notices or prohibition notices.

          If there is a prohibition notice served, the property may not be used for letting for up to six months (which would make it difficult for the landlord with tenants).

          The fines for failing to comply with an improvement notice are "unlimited".
          When I post, I am expressing an opinion - feel free to disagree, I have been wrong before.
          Please don't act on my suggestions without checking with a grown-up (ideally some kind of expert).

            They would also, if they were smart, come after you under Proceeds of Crime and confiscate all the money made in rent since the breach began.
