    Owner occupier

    I own a 4 bedroom flat and want to take in 2 lodgers. There is a one bedroom flat below me, will this make the house a HMO. There is only I person in there at the moment.

    It shouldn't change the status. If it was converted but not to the 1991 Building Regulations standards, and the flat below isn't owner occupied, it already is an HMO.

      It's never been registered or licenced as HMO

        Not all HMOs have to be registered or licensed, but I think all section 257 HMOs have to be, and we are talking about section 257 ones here.

          It will only be a s257 hmo if converted before 1992 and 50% of the flats are not owner occupied. Not all s257 HMOs have to he licensed. It depends on the policy of the local authority
