A tenant in a house I rent out has been told that when a nearby development (110 retirement flats) goes ahead that the developer will want to connect to the nearest mains drains by way of a "Sewer Requisition" to United Utilities.
There is a Private Road between the Public Highway and the Developers Site.
It is a Cul-De-Sac and the top of the road has no access to the developers site, (Unless he breaks through
The Private Road is very narrow, If cars are parked at each side of the road there is just enough room for 1 vehicle to pass between them.
There are 4 houses on this Private Road. The owner of a house on the other side of the road owns some of the width of the road.
The rest of the width was/is owned by the builder of the 4 houses and since they were built in 1994 the owners of the 4 houses have parked on the Private Road outside their houses and across the road which is partly owned by the owner of the house across the road. Without objection.
I note from the Planning Permission the Council States that the Road is a Private Road, but presumably it is not for them to say that the Developer need to get the permission.
What my tenant (and I) is worried about is two things, 1. If the Developer wants to bring Mains Drains down the road it will effectivley close the road as the road is not wide enough to accommodate road works with passing traffic. (until I retired I had a Farm and know how much room a JCB needs to operate>
and 2. Will the road become another access to the development.
