    Selling leasehold flat with missing service charge docs

    Hello everyone,

    I was wondering if you could help.

    Im disposing my interest in a leasehold flat I own. It’s taken a few months since initialising the sale but we are now close to exchange.

    My concern is we have recently (last 2 months) changed Managing agents. We had the old managing agents LPE1s and management pack.

    The new management agent is unable to provide a pack since the previous managing agent is unresponsive to their request for budgetary information to demand the service charge.

    The appointee of the new managing agent is no longer the freeholder and yet the new managing agent claims they only take instruction for the client the old freeholder who has also become unresponsive.

    The new landlord is {name removed} and are also unresponsive.

    what can be done in this circumstance? I have lost a few buyers already and I don’t want to lose another.

    is there indemnity insurance for this case?

    You must know whether you are paid up to date ( from your bank statement ) on paying service charge or fallen behind in arrears .

    You may have to leave a retention with your solicitor to cover service charge arrears up to the completion date.

      Your buyers will, quite rightly, require up to date answers to LPE1 queries, which covers much more than whether your service charge is paid up to date.
      If the managing agents and freeholder are being uncooperative then that's probably a good reason not to buy the flat.

        Indeed, however I always advise to select a company that does not require a non refundable deposit. This is why it is imperative that completion take place as early as possible on the day of completion and certainly before the removals start loading their vans.         One of the challenges here is to convince the people of the chain to arrange moving companies so on. Understandably, they worry that in case we change our mind in last minute then they end up with cancellation fees so on. Any idea what we can propose them to...
