    Advise on adverse possesion

    Hello all I’m hoping some of you can help point me in the right direction before I get started.

    I have recently saw a property that has been left to ruin for several years, I have looked into the property and it has been left empty since 1990 the owner passed away in 2003 with the property currently still not been given a new owner.

    The site is is very overgrown and very large with one dwelling an several out buildings.

    I am looking to take adverse possesion of the property, please could you advise me on steps to take - I understand I will need to secure the perimeter I have purchased the plans to check the exact boundaries of the land.

    I would not look to make this my permanent dwelling however would maintain the land and restore the property - would I experience any legal action when filling for adverse possesion if no one informs me to not access the land.

    The owner is clearly the estate-of-deceased or his heirs. No chance ...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      The owner on the property deeds is the Executrix however this has been the case since 2013 ?

        Could it simply be the case that the executor is biding their time?

        Any planning application history on your council website?

          Hi Anna

          You could try searching for desktop valuations of freehold. This service would be adequate for valuation purposes though not suitable re condition which would require a site survey. Nevertheless, speak with a company offering desktop valuations and ask them if condition impacts...

          Thank you for the advice. We basically know the price range of the freehold, it is more to validate it as an asset and to see if the value of it will be affected by actual state of the property.

          May I ask why you need the valuation?

          TRY THIS: telephone a solicitor that deals with enfranchisement (google 'enfranchisement solicitor' and put in your postcode). Call them and ask if they can recommend a surveyor specializing in valuing freeholds....

          There are lots of people who do valuations. As soon as you mention freehold - we will come back to you and they are still coming back.

          I'm really wondering if it is really worth to have it valued....

          I am surprised but you will just have to google or check online directories for surveyors in your area. Sorry, I cannot be of more help but there are plenty of surveyors offering freehold valuations.

          I am in an area of the country where the council retains the freehold on developments - ostensibly to avoid fragmentation of estates. My developer owned the head lease when I bought the property, and has since sold it to a leasehold management company. The head lease is a peppercorn rent to the council...

          We enfranchised our freehold at which point the head lease and our own lease were merged into our new freehold title....
