    Advise on adverse possesion

    Hello all I’m hoping some of you can help point me in the right direction before I get started.

    I have recently saw a property that has been left to ruin for several years, I have looked into the property and it has been left empty since 1990 the owner passed away in 2003 with the property currently still not been given a new owner.

    The site is is very overgrown and very large with one dwelling an several out buildings.

    I am looking to take adverse possesion of the property, please could you advise me on steps to take - I understand I will need to secure the perimeter I have purchased the plans to check the exact boundaries of the land.

    I would not look to make this my permanent dwelling however would maintain the land and restore the property - would I experience any legal action when filling for adverse possesion if no one informs me to not access the land.

    The owner is clearly the estate-of-deceased or his heirs. No chance ...
    I am legally unqualified: If you need to rely on advice check it with a suitable authority - eg a solicitor specialising in landlord/tenant law...

      The owner on the property deeds is the Executrix however this has been the case since 2013 ?

        Could it simply be the case that the executor is biding their time?

        Any planning application history on your council website?

          An instrument releasing a covenant needs to be made by deed. It also of course has to have the right words in it. You should also note that a release may not necessarily be effective to extinguish the covenant. To get the covenant removed from your title you need to satisfy the LR that it has been executed...

          Hi WFD, thanks for reply. Unfortunately Jubilee Owner lives abroad and I know wouldn't be interested. Another local extinguishment order just took 12 months.
          You can see on the plan that the triangle abuts the narrow street on one side. on the inner side is a ten foot wall which abuts the cemetery...

          The reality is that the assets of this insolvent lender (such assets including your house!) will have been transferred by the insolvency practitioner to another party. 5 years is a long time however. Have you _really_ not had contact or repayment requests in that period of time?
