    New owner old tenat

    Hi,

    i have recently acquired a commercial property from my dad, and want to use the building for my own use the tenant who is in there has contract till 2020 for the shop and store rooms (rooms have separate self contained entrance) above and i want to remove him and use for own use, can this be done?

    please help!

    Does the lease have a tenant break and is it contracted outside of the Landlord and Tenant Act 1954? If the answer to either of those is no, then you cannot get the tenant out... you may not even be able to get the tenant out at the expiration of the lease as the tenant may have rights of renewal and you may not meet the criteria for denying renewal for your own occupation. If you are able to oppose renewal then you're obligated to pay statutory compensation.

    Do you know if the tenant wants to remain in the property? If so you can try offering a premium to terminate the lease early.

      I think it has to be the case that the landlord cannot hope to settle a dilapidations claim if he denies the tenant's surveyor access, but I have not been able to find confirmation of that online. I suggest you check the point with a surveyor.
