    Gas leak: responsibility?

    My new commercial tenant (a rare animal in these strange times!) moved in a month ago with the benefit of a rent free period of 4 months.
    She's since complained that there was a significant amount of re-plastering needed, to keep her sweet I agreed to pay 50% = £900.

    She's now complaining there's a gas leak 'from the gas tap', and that Cadent, the gas distribution company, say it's the property owner's responsibility.
    There certainly wasn't a gas leak before she took over the property although I've no gas safety certificate to prove that.

    To my mind, if it's the gas tap (on the meter?) the responsibility lies with Cadent.

    If the leak is on the premises side of the meter then the responsibility should lie with the FRI lease-holder.

    I'm not trying to abdicate my responsibility as a landlord, but I'm keen not to be seen as a soft touch by the tenant.

    I'd appreciate your collective thoughts on this - and of course where the legal responsibility lies.

    Get it repaired immediately, have a Gas Safe Inspection done. The fact that your tenant has reported a gas leak means that if there is a fire you are not insured.
    Sort out who is going to pay for it later.
    You may find that your tenant need to be educated on the responsibilities of a FRIL

      Your responsible to have the gas safe check completed before the tenant occupies the property.
      How does she even know that a gas leak exists?

        Just depends on what the lease says, if it's full repairing as is usual then tenant is responsible, but in current climate and with safety in mind you might want to send a gas Safe engineer in and get it sorted. Can't be dear can it ?

          full refund of security deposit

          Them covering Commercial moving costs

          uplift - reasonable difference between existing lease cost v new up to and including break clause date - so if there if for example is a £ 200 difference...
