    Regular Late Payment

We have a tenant on a commercial lease who is being difficult! He has had the property since 2014 and has been acting up for the past 18 months or so. His lease ends in 2020. His rent is due on the 1st of each month but for the past year or so, despite being told nearly every month that his rent is due on the 1st, he pays up to a week late every month. The lease doesnt provide for any late payment and is very clear, 1st of the month. He hasnt provided any reason for his late payments and appears to be just doing it to be a pain. Can we start charging him a late payment fee please if we advise him that this is going to happen and if we can what would be a good daily amoun please? There is no mention of late payment fees in the lease. Thanks very much for any advice.

Be thankful you get paid at all IIWY. A number of my residential tenants pay up to ten days late, and I have no problem with it, as no mortgage to pay.

Now that you have informed them, i'm surprised why you aren't paying them of the mistake? What type of agreement did you have with the council as I can't believe it would have been a verbal one with no paperwork. If it was a lease, most leases have a clause stating the rent is due regardless if it has...

Regardless of any negotiations with the landlord for the renewal lease, if the tenant does not protect its renewal rights before the end date in the s25 notice then it would have no legal right to remain in occupation of the premises after that end date.

There are two ways to protect the...

"I had a clause added to the lease under the repairs section 'The tenant shall not be required to put the property in any better state or condition than it was at the time of this lease'."

Was a Schedule of Condition prepared at the onset and affixed the lease? If so then you...

I think it has to be the case that the landlord cannot hope to settle a dilapidations claim if he denies the tenant's surveyor access, but I have not been able to find confirmation of that online. I suggest you check the point with a surveyor.
