    a commercial tenant being in a property without a new lease

    Hi there

    I have a commercial tenant in my property and he has not yet signed a new lease as she is stalling over paying the 10% increase in the rent. She has verbally agreed to extending her contract for another 3 years but is picking holes in the new lease that has been offered to him.

    What is my and his legal position over not having a new lease in place?

    i think you are entitled to three months notice and vice versa, as the implication from your posting is that your tenant is holding over under the terms of an expired lease under part 2 of the landlord and tenant act 1954

      so is a standard term of notice to leave a commercial property 3 months and a residential is 1 month?

        Residential ones are two months from the landlord.
