    by helpmenot
I seem to be involved in a neighbour dispute and will try to stick to key info only. All advice appreciated.
Me and my husband jointly purchased a freehold property in 2016
We agreed a sale of the freehold in 2020
Our then buyer noticed that our physical boundaries did not match...

    Thanks for the replies.

We bought in 2015 from "a finance consortium, who took over from a firm who repossessed the property."
We weren't able to raise any general or specific enquiries for this reason.
    No boundary agreement was disclosed.
    The neighbours...

    Please clarify the history.

What was the position when you bought?

What have you done since you bought?

Was the boundary agreement disclosed when you bought?

If the boundary agreement is in writing have you seen it?

According tom the Land Registry, property boundaries are shown only in a general way on the Title Plan. To determine their positions and ownership more precisely it is necessary to look at each of the Land Registry documents for every bordering property, and to determine what these documents collectively...

  • Car Parking Problem
    by AlbertRoss
I currently have some retail shops which has a car park in front which I own. At the rear of the shops is an access lane that I own which leads on to a road. Where the lane joins the road there is a business, unconnected with my shops, which purports to be an MOT centre. The access lane has two parking...

  • Tenancy at Will
    by comm1985
Does anyone have a simple Tenancy at Will template I can use to document a short term commercial let?

Also given this is a temporary occupation
    1. Can I still request a security deposit?
    2. How would this be documented?

    Many Thanks

A tenancy at will is a bit of a slippery thing. One the whole you only argue you have a tenancy at will when things go wrong, for example you let someone in on the basis that they sign later and they never sign. Since it is in the nature of a tenancy at will that it can be ended at any time, anything...

  • Charging Commercial Tenant for Insurance
    by BEP
What is the standard for requesting payment from a commercial tenant for property insurance premiums, simply a letter or a formal invoice? Secondly, should this include the IPT.

The lease states the following under tenant obligations:

To pay to the Landlords within 14 days...

generally speaking nowadays the policy wording will say that tenants and mortgagees having an interest in cover will automatically have an interest in the insurance in the event of a claim. Unless you have a landlord who is impecunious or disorganised the only real benefit of having your interest noted...

    rentreviewspecialist,

Great answer thank you. The lease does state that the landlord should make reasonable endeavours to have the interest of the tenant noted on the insurance policy which I didn't do. So hopefully this will not be an issue.
