Limited Company and Inheritance tax
Parents own shares in a property investment company. Incorporated due to S24.
One parent passed away. I am running the property company.
I am thinking it is time to close the company, as the business is a burden. The company has a 25% loan, but frustratingly the loan is over 50% of the properties in company.
In the event of an untimely death of my second parent, how would beneficiaries pay inheritance tax if the available cash is held within the company?
Taking dividends out, seems harsh as higher-rate taxpayers, the tax rate could be up to 33.75%.
Inheritance tax is 40%. So it seems harsh to take out 40% from the company +33% to cover dividend tax just to pay the inheritance tax?
This feels like a form of double taxation—paying tax just to meet the IHT obligations. Is there a better way to approach this? Am I misunderstanding things?
